These Terms of Service (“Terms”) govern your use of Daovian websites and applications at www.daovian.com and app.daovian.com (the “Services”). By using the Services, you agree to these Terms.
If you do not agree, do not use the Services.
1. What Daovian is
Daovian provides software tools for Chinese metaphysical systems (such as calendars, Bazi charts, and related references) with an emphasis on reproducible calculation and citable sources. AI features, when enabled, are designed to explain engine outputs and sources—not to invent unverifiable destiny math.
2. Life reference disclaimer (important)
Outputs are for cultural, educational, and personal reference only. They are:
- Not medical, psychological, legal, financial, or immigration advice
- Not a guarantee of any future event, outcome, relationship, or business result
- Not a substitute for licensed professional counsel
You are solely responsible for decisions you make after reading any output.
3. Accounts
- You must provide accurate information and keep credentials secure
- You are responsible for activity under your account
- We may suspend accounts that abuse the Services, attempt to reverse-engineer protected systems in bad faith, or violate these Terms
Email sign-in may be used. Keep access to the email address you register.
4. Acceptable use
You agree not to:
- Use the Services to harass, defraud, or unlawfully discriminate against others
- Attempt unauthorized access to systems or other users’ data
- Overload infrastructure with automated scraping beyond normal browsing or documented APIs
- Misrepresent Daovian outputs as certified professional judgments
5. Intellectual property
- The Daovian name, logos, product UI, and original documentation are owned by us or our licensors
- Traditional classics and third-party open corpora remain subject to their own licenses; we do not claim ownership of public-domain or third-party texts we cite
- You retain rights to the personal inputs you enter; you grant us a limited license to process them solely to provide the Services
6. Free and paid plans
- Free features may include chart facts, algorithm rules, and limited history as described on the Pricing page
- Paid (“Pro”) features may include AI explanations, fuller source expansion, date selection tools, and higher limits
- Prices, when published and checkout is enabled, are billed via a payment processor (Merchant of Record or successor). Subscriptions renew until canceled through the billing portal or documented cancellation path. Paid checkout is not available during the current soft-free period; signed-in users receive full product capabilities without charge until billing launches.
- Fees are generally non-refundable except where required by law or explicitly stated at purchase
7. Continuity & roadmap
The product app is generally available for signed-in use. Features may still change as we deepen existing modules. Marketing pages describe shipped capabilities and documented boundaries; we do not promise fixed dates for future enhancements.
8. Third-party services
The Services rely on vendors (hosting, email, payments, model providers). Their outages or policy changes may affect availability. We are not liable for third-party failures beyond our reasonable control.
9. Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that outputs are complete, accurate for every tradition or school, or suitable for any particular decision.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAOVIAN AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US$50).
Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted.
11. Indemnity
You agree to indemnify and hold Daovian harmless from claims arising out of your misuse of the Services or violation of these Terms, except to the extent caused by our willful misconduct.
12. Changes
We may update these Terms. The updated date will change at the top of this page. Continued use after material changes constitutes acceptance where permitted by law. If you disagree, stop using the Services and close your account.
13. Governing law
Daovian is currently operated by an independent developer. Disputes under these Terms should first be resolved amicably. If that fails, the laws and courts of the operator’s primary place of residence apply, except where mandatory consumer protections in your country require otherwise. If a registered entity is formed later, this page will be updated.
